En r\u00e9alit\u00e9, il existe de nombreuses formes juridiques et fiscales qui pr\u00e9sentent chacune des avantages et des inconv\u00e9nients :<\/p><h3>Investir en nom propre (ou en direct)<\/h3><p>Investir en nom propre revient in fine au m\u00eame r\u00e9gime fiscal que l\u2019option SCI transparente (IR) avec un inconv\u00e9nient majeur au moment du d\u00e9c\u00e8s qui conf\u00e8re aux indivisaires une cod\u00e9tention du bien source parfois de difficult\u00e9\/conflit entre eux\u2026<\/p><p>La responsabilit\u00e9 du particulier est alors illimit\u00e9e.<\/p><h3>La SCI (Soci\u00e9t\u00e9 Civile Immobili\u00e8re)<\/h3><p>La Soci\u00e9t\u00e9 Civile Immobili\u00e8re est la structure la plus courante pour investir avec un associ\u00e9. Elle permet d\u2019opter, soit pour l\u2019imp\u00f4t sur les soci\u00e9t\u00e9s, soit pour l\u2019imp\u00f4t sur les revenus, ce qui revient dans ce dernier cas \u00e0 investir en nom propre.<\/p><p>La SCI est tr\u00e8s limit\u00e9e dans son objet social qui, par d\u00e9finition, ne peut pas entrer dans le domaine commercial (marchand de bien, investissement d\u2019appartements meubl\u00e9s, locaux \u00e9quip\u00e9s, etc.).<br \/>Cependant, la SCI est un tr\u00e8s bon moyen pour se laisser la possibilit\u00e9 d\u2019arbitrer en mati\u00e8re de fiscalit\u00e9.<\/p><p>La responsabilit\u00e9 du particulier reste encore illimit\u00e9e.<\/p><p>L\u2019objet social pourra \u00eatre la location nue.<\/p><h3>Soci\u00e9t\u00e9s commerciales (SARL ou SAS)<\/h3><p>Les soci\u00e9t\u00e9s commerciales permettent d\u2019augmenter la capacit\u00e9 d\u2019autofinancement de l\u2019investissement immobilier gr\u00e2ce \u00e0 l\u2019imposition sur les soci\u00e9t\u00e9s. Cette structure juridique est appropri\u00e9e pour pallier aux inconv\u00e9nients de la SCI relatifs \u00e0 l\u2019investissement.
